Subcontractors and Work-Related Death or Injury
The recent tragic death at the Welspun facility here in Little Rock raises significant legal issues. Who is responsible for worksite safety and what legal rights does a subcontractor and his employees have if injured by employees of others?
For folks working as subcontractors at another person’s or business’s facility or job site, certain dangers facing the subcontractor can be unknown. Employees of others, including the general contractor or owner of the facility where a person is working, can cause injury or damage to the employees of a subcontractor. Subcontractors in many instances may have no control over the safety procedures at the facility or work site and no control over the employees of others.
Subcontractor employees injured by others may well have what is called a “third party lawsuit” against the business or folks responsible for safety at the job site or facility where they were working.
