Aircraft Personal Injury
Aircraft related personal injury litigation is an area where special training, starting with being a pilot and experience in the area are essential if a law firm is to provide effective representation. Unfortunately, many law firms will undertake aircraft accident cases, without this knowledge and experience, and even many with it, don’t look beyond issues of pilot error. Where the pilot is the injured party in an aircraft accident, or where a passenger is injured and the pilot is either not at fault or has inadequate liability coverage, which is often the case, it is essential to look beyond pilot error and consider other conduct that may have either contributed to causing a crash or other accident or enhanced the injuries or caused needless death. Failure to explore negligence on the part of third parties, such as aircraft designers and manufacturers may result in a disappointing recovery or no recovery at all.
Aircraft Manufacturer Liablity
In many instances, the aircraft manufacturer, maintenance facilities and even the government, in connection weather and air traffic control service, may have responsibility for causing and accident or crash. It is our belief that many claims go uncompensated or inadequately compensated because attorneys fail to aggressively consider such contributing factors.
Perhaps among the most frequently overlooked areas of liability are issues related to crashworthiness. Even more than automobiles, it is foreseeable during the long life spans of general aviation aircraft, that they will be involved in accidents. Yet, most light aircraft manufacturers have given little consideration to injury reduction through proper design with crash worthiness in mind. Even elementary considerations, such as providing for ready egress from an aircraft after a crash event, have often been inadequately addressed or just plain ignored, resulting in unnecessary injury and death. Such oversight is particularly egregious given the high potential for post crash fire in general aviation crashes.
When we evaluate Aircraft accidents and crashes at McMath Woods P.A. we consider all possible contributing factors, not just pilot error.
